Industrial Commission</a>, a government agency responsible for enforcing workers&#8217; compensation laws, is facing scrutiny after an investigation found that it was allowing small businesses to ignore laws that require them to provide workers&#8217; compensation.</p>
<p>Following the investigation, Governor Beverly Perdue is whipping the seven-member commission back into shape. Each member of the commission is appointed to it and makes a handsome $119,000 a year. Despite the high pay, the members of the group embarrassed the governor by not doing their jobs.</p>
<p>The commission must now begin working on its three-month backlog of cases.</p>

			<content:encoded><![CDATA[<p>A 35-year-old California man is facing four different charges of insurance fraud after he was found to have been fighting in MMA matches while earning an income through the workers&#8217; compensation program.</p>
<p>Raphael &#8220;The Noodle&#8221; Davis filed a workers&#8217; compensation claim in 2008 after he was allegedly injured while working as a firefighter for the city of Los Angeles. He received these supplemental income payments until May 2011. While he was out of work as a firefighter, he was training and fighting as a mixed martial arts fighter.</p>
<p>Davis was arrested at his home on April 10. He did not object to the arrest, and was out on bail in one day&#8217;s time. He will be back in court on May 1, and at that time his arraignment will begin.</p>

			<content:encoded><![CDATA[<p>Two men suffered severe burns from a <a href="http://www.fayettevilleworkerscomp.com/">workplace accident</a>, and the second man has died as a result of the complications. The accident took place in Ohio on March 1 at the Struthers treatment plant.</p>
<p>The employees were working as maintenance men for the plant, and on the day of the explosion they were inside the room containing the compressor. They were working with wires when a spark ignited a tank of methane gas, and caused it to fill the room. They were in critical condition when emergency personnel arrived at the scene.</p>
<p>Both men were housed at the burn unit in a Pittsburgh hospital. The first man passed away on March 29, and the second man lost his life this week as a result of his burn injuries.</p>
<p>The exact cause for the explosion is unknown at this time, and the Workers&#8217; Compensation Bureau in Ohio is looking into the case.</p>

According to a 2010 research study that was conducted by the Texas Department of Insurance, roughly 15 percent of Texas businesses that have over 500 workers do not possess workers&#8217; compensation coverage through the state.</p>
<p>Individual injuries have a maximum allotment of funds in a privately funded program, as compared to unlimited in most state programs. Companies that create their own policies also have the right to determine how long they reimburse injured workers for their time, and how much they are reimbursed each pay period.</p>

<p>The company was accused of violating 22 different health and safety codes set forth by the Occupational Safety and Health Administration. They had been monitored since 2010, when they failed to properly train employees on different procedures. Since then, the meat processing plant has violated health codes on several occasions.</p>
<p>After that, another inspection by the OSHA turned up numerous health and safety violations. These violations included; blocked emergency exits, absence of protective guarding around equipment, missing handrails, and electrical violations.</p>

			<content:encoded><![CDATA[<p>Yesterday in Salem, Virginia, a steelworker died after he was involved in a <a href="http://www.fayettevilleworkerscomp.com/">workplace accident</a>. The steelworker was employed at the New Millenium Building Systems company.</p>
<p>The man, along with fellow employees, were near a tractor-trailer unloading steel trusses on Monday morning. One of the trusses rolled off of the trailer, ultimately pinning the man&#8217;s legs to the ground. The truss, which weighed 8,000 pounds, had to be removed by several rescue workers.</p>
<p>The rescue workers had the steelworker airlifted to a local hospital to attempt to save his life. Unfortunately, the man&#8217;s injuries were too severe and he passed away hours later. An investigation into the incident has begun, and at this time the identity of the man is being withheld.</p>
<p>We would like to offer our condolences to the victim&#8217;s family and friends.</p>

<p>His fraudulent scheme consisted of falsifying insurance premiums on workers&#8217; compensation claims for the state. The man changed his name and profession in order to carry out his plan. The scheme unfolded between 2005 and 2008. He used all of the money that he illegally obtained to buy extravagant items and to fund an equally extravagant lifestyle.</p>
<p>He was convicted of the fraud, and his sentencing hearing just ended in a North Carolina court. The man will spend the next five years in prison for his actions. Upon his release, he will be under supervision for three years. He was also ordered by the judge to pay more than $2 million in restitution.</p>
